Selling a Home During Divorce in Scottsdale and Greater Phoenix

Selling a home when two people have to agree, with clear communication to both of you.

What selling a home during divorce involves

Selling a home during divorce in Phoenix or Scottsdale has all the usual steps of a home sale, plus one more: two people who both have a say, and who may not be communicating easily right now. Decisions about price, repairs, showings and offers need both signatures, and a sale can stall if either person feels left out or rushed.

Most people in this situation want the same things. They want the process to be fair, they want to know what is happening, and they want it to be over without costing more than it has to. Some want to sell quickly. Others need time. The divorce agreement, and sometimes the court, may set part of the timeline.

This page explains how I handle the real estate side. It is not legal or financial advice, and I work alongside your attorneys rather than in place of them.

How I help when two people have to agree

I am an Associate Broker with Coldwell Banker Realty, licensed since 2003, with education and experience in divorce-related real estate. The most important thing I bring is a steady process that treats both parties the same.

That means the same information goes to both of you, at the same time. Price recommendations come with the reasoning and the comparable sales, so neither person has to take my word for it. When an offer arrives, both of you see it side by side with the terms laid out: price, financing, contingencies, concessions and timing. When a decision is needed, you both know what it is, what the options are and how long you have.

I also coordinate with each side's attorney so the sale fits your agreement, and I keep a clear record of what was shared and decided. That record protects both of you. If the home needs preparation, I help you agree on what is worth doing and how the cost is handled.

If one of you is keeping the home instead of selling, a clear home value can still help that conversation.

What you can expect

  • Even-handed communication. Both parties get the same information at the same time.
  • Price reasoning you can both see. Comparable sales and listings, not a number to take on faith.
  • Coordination with your attorneys. So the sale follows your agreement and any court orders.
  • Decisions explained before they are due. Options, tradeoffs and timing in plain language.
  • A clear paper trail. What was shared, what was decided and when.

The four steps behind the process are on my page about how I sell a home.

Decisions most divorcing sellers face

Every divorce is different, but the same practical questions come up in most home sales. It helps to talk them through with your attorneys early, so the sale is not held up later.

  • Who lives in the home until it sells? And how are showings handled if one person is still there?
  • Who pays the mortgage, taxes, insurance and utilities in the meantime? Missed payments during a sale can create problems for both of you.
  • Who pays for preparation? Cleaning, repairs or staging costs, and whether they come out of the proceeds.
  • How are decisions made? Price changes, offers and repair requests all need agreement, so it helps to decide ahead of time how you will communicate and how quickly.
  • How are the proceeds handled at closing? Your agreement or your attorneys decide this, and the escrow company follows those instructions.

My part is making the real estate decisions clear and giving both of you the same information to make them with. The legal and financial answers come from your attorneys and advisers.

Can we sell before the divorce is final?

Sometimes. It depends on your agreement and any court orders. I coordinate with your attorneys so the sale fits whatever has been decided.

Who do you represent in a divorce sale?

The owners, as set out in our listing agreement. I keep communication even-handed so both of you are informed at every step.
